Zephyr’s action is in response to Primo’s 3 December 2010 suit alleging claims for design patent infringement. Zephyr believes that Primo has falsely claimed infringement in order to affect the business relations of Zephyr.
“Primo’s ‘schoolyard bully’ tactics seem to be an attempt to ward off fair competition through intimidation and strong-arming,” said Patrick Wind, president of Zephyr.
Zephyr Fluid Solutions was established to promote bulk water use – protecting the environment by promoting recycling.
“We have a long history of respecting the intellectual property of others,” said Wind. “In our novel design, we deliberately considered existing patents so that we may offer innovative solutions to bulk water bottlers, enabling them to promote and effectively merchandise bulk water products. Our water bottle return cage is clearly distinguishable from the patented designs held by Primo and plainly cannot be confused with Primo’s patented design.”
Zephyr Fluid Solutions filed its Civil Action in the US District Court for the District of Connecticut.
